Right of Withdrawal
If the customer is the consumer he has the right of withdrawal from the contract - by law - according to the following:
EGBGB Appendix 1 of Art. 246a § 1 Para. 2 Phrase 2. BGBl. I 2013, 3642 - 3670
You have the right to withdraw from this contract within 14 days without stating a reason.
The revocation period is 14 days starting with the day on which you or another authorized person (excluding the carrier) receives or has already received the latest goods.
In order to execute your right of withdrawal, you have to inform us (ROCKWELL GmbH, Goltsteinstraße 25, 40211 Düsseldorf, widerruf(at)rockwell-headgear.com) via an unequivocal explanation (e.g. a letter sent by post or email) about your decision to retract from this contract. You may use the enclosed withdrawal sample form, however it is not mandatory.
To comply with the revocation period, it is sufficient to send a message stating that you would like to use your right of withdrawal before the revocation period ends.
IMPLICATIONS OF WITHDRAWAL
In case you withdraw from this contract, we have to refund every payment that we received from you including the delivery costs (except for additional costs that may accrue in case you choose another form of delivery as the cheapest standard delivery we offer) immediately and within 14 days after we receive the message of your withdrawal from this contract. We will use the same method of payment that you chose for the initial transaction, unless another arrangement was made; We will not charge any additional fees for this refund under any circumstances. We have the right to refuse the refund, until we are in possession of the products or until you have provided evidence that you have sent back the articles, depending on whatever occurs first.
You are obligated to send the products to ROCKWELL immediately and by no later than 14 days from the day you informed us about your withdrawal from the contract. The deadline is met, if you send the products before the deadline of fourteen days expires. We will bear the costs of the return of the products.
You will be held accountable for any possible depreciation, if an assessment of the appearance, characteristics and functionalities of the product determines that the depreciation is the result of inappropriate handling by you.
